Terms and Conditions – Bennett and Claire
Article 1 - Definitions
The terms below carry the following meanings throughout these terms and conditions:

Cooling-off period: the period during which a consumer is allowed to use the right to cancel;
-

-
Day: any day on the calendar;
-
Long-term transaction: a remote agreement covering a series of products and/or services whose supply and/or performance is distributed across a period;
-
Durable medium: any means that lets the consumer or the trader keep personally addressed information so that it can be consulted later, for as long as the purpose of that information requires, and that permits the stored information to be reproduced exactly as it was.
-
Right of withdrawal: the possibility for the consumer to back out of the remote agreement while the cooling-off period runs;
-
Trader: any individual or legal entity that supplies products and/or services to consumers at a distance;
-
Distance contract: a contract formed under a trader's organised system for selling products and/or services remotely, where up to and including the moment of contracting only one or more means of distance communication are used;

Article 3 - Applicability
Every offer made by the trader, as well as every distance agreement and order between the trader and the consumer, falls under these general terms and conditions.
The consumer will receive the wording of these general terms and conditions before any distance agreement is entered into. Where that cannot reasonably be done, the consumer will be told beforehand that the terms may be inspected at the trader's premises, and a copy will be forwarded at no charge and without delay if asked for.
Where a distance agreement is formed electronically, the previous paragraph notwithstanding, the text of these terms can be provided to the consumer by electronic means ahead of the agreement, in a form the consumer can simply save on a durable medium.
Should any provision of these general terms and conditions be, at any time, entirely or partly void or annulled, the agreement and the rest of these terms stay valid, and the affected provision will at once be substituted, after mutual consultation, by one that matches the original purpose as nearly as can be.
Article 4 - The offer
-
An offer that is time-limited or attached to conditions will say so expressly.
-
Offers are non-binding, and the trader may modify or adjust them.
-
Each offer holds a complete and correct description of the products and/or services on sale, detailed enough for the consumer to judge the offer properly.
-
The pictures show the products as they really are. The trader is not bound by evident mistakes or errors.
Article 5 - The agreement
-
The agreement comes into being when the consumer accepts the offer and fulfils the conditions attached to it.
-
When the consumer accepts the offer by electronic means, the trader will promptly confirm by electronic means that the acceptance was received.
-
Following US consumer standards, an order can be cancelled solely during the 24 hours after it is placed, since processing can start once that time has passed. Beyond 24 hours cancellation is no longer possible, yet the product can still be sent back within 30 days of receipt, under the conditions of the return policy.
Article 6 - Right of withdrawal
A consumer may send the product back within 30 days of receiving the order and does not have to give any reason.
In that time the consumer has to treat the product and its packaging carefully, and may use the product only as far as needed to establish its nature and how it works.
Unless stated differently, the consumer bears the cost of shipping the return.
The refund is paid out within 5 business days once the returned item has arrived at our warehouse and been inspected. Bennett & Claire may hold back the refund until the returned item is in its hands.
Article 7 - Costs in case of withdrawal
Paying for the return shipment is the consumer's duty.
Money is returned through the payment method that was used for the original purchase, unless something else is agreed.
